| 2 years imprisonment, fine Rs 20,000 to CAPD Clerk in trap case | | | Jammu, Dec 12 (JNF): Special Judge Anticorruption Jammu Puneet Gupta today awarded two years imprisonment and fine Rs 20,000 to Hira Lal Sharma then Clerk in the CAPD department who was caught red-handed by the VOJ. According to the VOJ case, on April 13, 2006 complainant lodged a written report with the Vigilance Organization Jammu that he got prepared the file for installation of Atta Chakki from Billawar and the Tehsildar had sent the file to Deputy Commissioner Kathua. The file marked by the Deputy Commissioner to concerned clerk of Food & Supplies and complainant visited the concerned 8 times in a month. The accused is demanded Rs 2500/- from the complainant, upon this complainant lodged a complaint with VOJ and VOJ constituted a trap team and laid trap and caught red-handed accused while demanding and accepting bribe money. Special Judge Anticorruption Jammu Puneet Gupta after hearing Chief Prosecuting officer Parshotam Sharma appearing for the Vigilance whereas Adv Anil Bargotra appearing for the accused person, observed that the accused is held guilty for offences u/s 161 RPC and section 5(1) (d) r/w section 5(2) of J&K Prevention of Corruption Act as the prosecution has been able to prove its case beyond shadow of doubt, the accused is liable to convicted and is convicted for the offences mentioned above. Court awarded punishment to the accused and ordered that accused is sentenced to undergo imprisonment for a period of one year and fine Rs 10,000/- u/s 161 RPC. The accused is also sentenced to undergo imprisonment for a period of one year u/s 5(2) of PC Act and is also held liable to pay fine Rs 10,000/-. Court clarified that both the sentences shall run concurrently. |
