| Accused acquitted in NDPS case | | Doubtful, tainted investigation | | Jammu, Dec 12 (JNF): Principal Sessions Judge Udhampur AK Koul today acquitted Vishal S/o Karan R/o Kamalpur, UP from the charges of NDPS Act on the basis of tainted and doubtful investigation. According to the police case, on June 25, 2008 Truck No.HR01GA/0374 was intercepted by a police party headed by Onkar Singh, at Manwal. The Truck in question was being driven by accused at the relevant time. 15 packets were found in the cabin of the Truck pursuant to search. Suspecting a foul play the police party informed Dy.S.P telephonically, who came on spot and search of the cabin led to the recovery of 15 packets of poppy straw. 15 Samples of 100 grams each were separated from the packets for being forwarded to FSL Jammu for chemical examination. The message was flashed to police station concerned on the basis of which the case was registered against the accused. After conclusion of the investigation the investigating officer was of the view that accused was in conscious possession of 15 packets of poppy straw weighing 8 kgs and 700 grams and so his complicity in commission of the offences u/s 8/15 NDPS Act was established and accordingly investigation culminated in this charge sheet. Principal Sessions Judge Udhampur AK Koul observed that The witnesses who have deposed in the case have also contradicted each other on various aspects. The prosecution has failed to explain the lapses committed at various stages of investigation and the resultant effect is that the case fails. The accused is so acquitted of all the charges. |
