| Justice Bedi gives all clean chit; Munshi, DySP penalized for dereliction of duty | | NC worker Haji Yousuf's murder mystery solved? | | Syed Junaid Hashmi JAMMU, Dec 22: Worst fears of NC worker's family have come true! Justice Bedi Commission has delivered the judgment, absolving Chief Minister Omar Abdullah of the accusations leveled against him while ruling out any foul play in the incident that took place last year. Like many other earlier commissions, Justice Bedi has stamped innocence of high and mighty, politically empowered and officially patronized ones. Government claims that justice has been delivered in the alleged murder of National Conference (NC) worker Haji Mohammed Yousuf Shah. Those guilty have been found out and are likely to be penalized by the Government in the next few days. Action on the report would be swift and fast, a tweet is likely to assure commoners across the State. Haji Yousuf family has been told that whatever they had been saying was all lie and aimed at tarnishing the image of higher ups in the political, administrative and policing circles. Dr. Noor, according to excerpts released by Law Department, has confirmed, what Government machinery especially political dispensation said from day 1. Death of Haji Syed Mohammad Yousuf was caused by myocardial infarction i.e. a "heart attack" and that no suspicious circumstances can be spelt out. IG Security Raja Aijaz Ali arrested the deceased NC worker Haji Yousuf, from the Chief Minister's office on 29th September 2011 after the registration of FIR No. 17/2011 at 10 pm. Law department has preferred silence about all others who were present in the room especially MoS (Home) Nasir Aslam Wani and DySP Kulgam Shabir Ahmed. The department has preferred leaking out specific portion of the report and desisted from making the entire report a public document. The lone man, Justice Bedi has found no evidence suggesting that the deceased had not received proper treatment while in the hospital. He has given an authoritative clean chit to Dr. Kuchay and said that he had done his duty as per the needs of the patient. Further, the commission has praised the then IG Security Raja Aijaz Ali, stating that he had discharged his duties as was required. With all powerful and well-connected accused individuals having been absolved, the commission has trained guns on two low ranking officers, a Deputy Superintendent of Police posted in Crime Branch Bashir Ahmed Ganai and a Munshi, Nazir Ahmad. Commission has seemingly termed them negligent and delinquent. It has held them responsible for dereliction of duty and said "DySP, Bashir Ahmad Ganai and Munshi, Nazir Ahmad who appeared as OW2 and OW10 respectively, are, therefore, held liable of having failed to discharge their duties as per law." None has been held responsible for death or what still many believe was a political murder. According to specific excerpts released by Law Department's 'extraordinary brilliant' Law Secretary Ghulam Hassan Tantray, the poor DySP had admitted before Justice Bedi that he had not conveyed the information about the arrest and detention of the deceased Haji Yousuf to his relatives but had passed on this duty to Munshi, Nazir Ahmad. This seems to have seized the matter for him. The poor DySP along with Munshi is likely to face the wrath of Government, if the sources in the Law Department are to be believed. However, the commission's 96 page report has seemingly not taken note of the allegations leveled by the family of deceased and preferred to go the version of the Government. This is what relatives of Haji Yousuf are listening to four sentences of the probe report made public by the Law Department. Law Secretary G.H. Tantray received the 96 page report of Justice H.S Bedi, Commission of Inquiry, inquiring into the circumstances leading to the death of Syed Mohammad Yousuf, here today. Justice H.S Bedi, Commission of Inquiry was appointed by the Government vide Notification SRO 340 dated 18th November, 2011 and the term of the Commission was extended from time to time upto December 28, 2012. The Commission held its hearings on 22 days. 17 persons have filed affidavits before the Commission. In addition 11 persons have filed additional affidavits. Commission has recorded statement of 21 persons and perused various documents. Commission submitted report today. In the morning, Omar tweeted, "Justice Bedi has submitted his inquiry report to State Law Secretary. Have asked for the findings to be studied before sharing with me." "Report was submitted to me at around 10 am. It will take me around a week to study before submitting it to the Cabinet," Ghulam Hassan Tantray told Early Times. It needs to be reiterated that on September 29, 2011, Haji Yousuf Bhat accused of taking bribe for ensuring seat in Legislative Council, was called by Omar Abdullah to his Srinagar residence, where he handed him over to the police Crime Branch. On the very next day, Yousuf died in police custody and the opposition also alleged foul play. |
