| ‘Advisors with fancy labels enjoy powers of ministers’ | | Appointment of CM's advisors, chairpersons anti-constitutional: NPP | | Early Times Report JAMMU, Jan 3: The Jammu and Kashmir National Panthers Party (NPP) has termed the appointment of Chief Minister's advisors and vice chairpersons of various boards as unconstitutional. The NPP urged President of India and J&K Governor to take cognizance of such appointments as the same were `a blatant transgression of the Constitution by the National Conference led Government.' Addressing a press conference here today, NPP MLAs Harsh Dev Singh, Balwant Singh Mankotia and Yash Paul Kundal said that NC is violating Constitutional provisions for their petty personal gains. "Giving Cabinet and MoS status to these people without taking oath of the Constitution is a gross violation of Constitution," said Harsh. Explaining his point, Dev said that Section 36 and Section 38 of State Constitution categorically provided that Ministers shall be appointed by the Governor with Section 38 further providing that number of Ministers shall not exceed twenty percent of the total membership of State Legislature. Singh said that the State Government in utter disregard to the Constitutional provisions has appointed several of its political activists on key positions with fancy labels of advisor and Political Advisor and conferred Ministers status upon them without the approval of the Governor as per the mandate of Section 36 and 38 of the Constitution. He said such Ministers appointed through back door by the Government enjoy all facilities, powers and privileges as are enjoyed by Ministers appointed under the Constitution. He observed that the back door Ministers are not only enjoying powers of regular Ministers but are also actively interfering in the general governance and day to day administration of the affairs of the State. NPP MLAs appealed to the President of India and State Governor who are the Constitutional heads of the country and State respectively, to take due cognizance of the blatant violations of Constitution and sought immediate issuance of orders divesting the said extra-constitutional authorities of the Ministerial status held illegally by them. Replying to the query whether this statement is his counter to Devender Singh Rana's earlier statement, Harsh Dev said, "No, this is not. I have just presented the facts and nothing else." |
