| Court denies bail to accused in rape case | | |
Jammu, Jan 3(JNF): Principal Sessions Judge Kathua MK Hanjura today rejected the bail application of Raj Kumar s/o Krishan Chand aged 32 yrs r/o Dhar Jhankar Tehsil Basholi District Kathua who was allegedly involved in a rape with his 11 yrs old Cousin.
While rejecting the bail application of accused, Principal Sessions Judge Kathua MK Hanjura after hearing Adv Dharmesh Sharma appearing for the accused and Public Prosecutor Ravi Kumar Gupta observed that in the instant case the prosecutrix aged 11 years although has turned a volte face to the prosecution case in her statement recorded by this Court.
Yet in her cross-examination, she had admitted to have made a statement u/s 164-A CrPC before a Magistrate where she had stated that she has been ravished by the accused who is her cousin.
The mother of the prosecutrix had stated in her statement that she saw the accused assaulting her daughter sexually. In a case like the present one, Court has not only to see how the crime has been committed but the reaction of the society towards the law breakers has also to be noticed. |
