| Court awards life-imprisonment to murder accused | | | EARLY TIMES REPORT
Anantnag, Jan 3: A local court here in South Kashmir's Anantnag district awarded life imprisonment to the two accused in kidnapping and murdering of a local businessman Principal Sessions Judge Anantnag, Ab Rashid Malik today awarded life-imprisonment to Fayaz Ahmad Shah S/o Ghulam Hassan Shah R/o Babanad, Shopian and Mohammad Syed Bhat S/o Mohammad Abdullah Bhat R/o Dirhama for committing murder of Mukhtar Ahmad of Dangarpora Anantnag. Principal Sessions Judge, after hearing Public Prosecutor Abbas Hamid Dar for the state and defense Advocate Mushtaq Ahmad Malik for the accused, observed that 'a crime u/s 302 RPC attracts the punishment of death or imprisonment for life and fine. Court awarded life-imprisonment u/s 302 RPC with 120-B RPC and rigorous imprisonment for five years and fine of Rs.5000/- each for the offense u/s 302 RPC and in default of the fine to further imprisonment for six months each. The court directed that accused shall be lodged in Central Jail, Srinagar to serve out their sentence. However the court made it clear that the sentence as laid down u/s 374 of the Code of Criminal Procedure is not to be executed unless it is confirmed by High Court. According to the police case on 10 October 2003, the accused namely Fayaz Ahmad Shah and Mohmad Syed Bhat with the intention to kill the accused kidnapped, and later left his body at Kanalwan Bijbehara. Police lodged FIR 302, 364 RPC and after completion of the investigation challan was presented in the competent court before ten years.
