| Court directs 'further probe' in closure report of houses set on fire | | | Early Times Report Jammu, Jan 7 (JNF) : In the rarest of the rare case the Court directed investigating agency police for further careful investigation of the case in which mob allegedly set houses on fire belonging to minority community. According to the police case that on December 22, 2007 a mob comprising 1500 to 2000 people went berserk, they set number of houses on fire at Village Surjan Tehsil Bani District Kathua belonging to the minority community accusing them of Cow Slaughter. Police after investigation filed closure report in the Court of Principal Sessions Judge Kathua as 'not proved.' On receipt of the closure report, court issued notice to complainants for filing objections and they filed objections pleading there in that the accused whose name have been detailed in the FIR set their houses on fire and damaged their property. They further stated that the police authorities recorded the statement of the eye-witnesses and instead of holding them guilty they filed a closure report in the case after yielding under the influence of the accused. Principal Sessions Judge Kathua MK Hanjura took serious note of the closure report filed by the police and the police authorizes ought to have proceeded against the persons named by the witnesses in their statement u/s 161 CrPC. Principal Sessions Judge Kathua further observed that the law is that not only a fair trial but a fair investigation is a part of the constitutional rights, investigation must be fair, transparent and judicious as it is the requirement of law itself and thus directed further careful investigation of the case. |
