Jammu, Mar 13 (JNF): In a petition filed by Chief Engineer P&MM Muhammad Qasim, DPS Bali, AEE, PDC, Executive Engineer RGGVY, Rajouri Poonch, Nisar Hussain, AEE, Commercial Division Jammu (C&S Wing), Rajiv Chopra, JE Store, AE, EM&RE, Division 2nd Jammu, Summit Puri JE, Electric Central Stores Jammu, Barkat Hussain JE, TLCD-1 Jammu and Murir Hussain AEE, EM&RE Division Batote sub-division Jammu, seeking quashment of suspension order passed by the Govt on February 14, 2013 whereby they have been placed under suspension with immediate effect till completion of disciplinary proceedings on account of certain lapse attributable to them with regarding complete failure of 132 KV transmission towers in District Poonch& District Rajouri resulting into total snapping of power supply in these two districts for days together. Justice Virender Singh of J&K High Court Jammu Wing after hearing Sr. Adv Sunil Sethi assisted by Adv Ravi Abrol appearing for the petitioners whereas AAG Seema Shekhar appearing for the state observed that impugned order challenged on the ground of discrimination. Substantiating the contention, it is averred and submitted that the petitioners have been picked up to exclusion those who are virtually involved. However, in view of the fact that the enquiry has already been initiated by appointing an enquiry officer, Court deems it proper to defer the instant petition with aview to enable the state respondent to conclude the enquiry within two months time only instead of three months as indicated in the Govt Order. Court further said that report whereof shall be brought on record before next date of hearing. If the enquiry officer fail to submit his findings/enquiry report, the petitioners shall be at liberty to seek consideration of the matter in spite of non-availability of enquiry report. |
