| Accused acquitted in rape case after 15 years investigation, trial | | | ET Report
Jammu, Aug 13: Presiding Officer Fast Track Court Jammu Sanjeev Gupta has acquitted Suresh Kumar of Bhandari Mohalla Kishtwar who was facing trial in allegd kidnapping and rape case for the last 15 years. According to the police on 16 July 1998 father of the prosecutrix appeared in the police station RS Pura and lodged an oral report with the allegations that her daughter 20/21 years along with her two friends went to the temple of "Bawa Wali Mata" on July 14. In the evening two friends of her daughter told the complainant that prosecutrix while returning back alighted from the bus at RS Pura stand. He had made frantic efforts for her search but no clue was found. The said missing report was entered into police station, however, on July 19, 1998 complainant again approached the police and told that he came to he know that her daughter had been enticed away by Suresh Kumar who took her some unknown place. The police registered a case and recovered the prosecutrix from the custody of Suresh Kumar and recorded the statement of the prosecutrix and presented challan u/s 376/366 RPC. The court after going through the statement of the prosecutrix observed that the story narrated by the prosecutrix clearly points to her elopement rather to the fact that he had been abducted and subjected to forcible sexual intercourse by the accused and held that the prosecution has miserably failed to prove its case against the accused which is as such dismissed and the accused is acquitted of the charges levelled against him.
