| Narco smuggler denied bail | | | Jammu, Oct 25: Justice Janak Raj Kotwal of State High Court rejected the bail application of one Hanief truck driver from whose custody 180 kg poppy straw powder was recovered and he was booked u/s 15 NDPS Act. According to the police case , on February 28, 2010 a vehicle reportedly loaded with popular bats of M/S Valley Agro Products Milk Gund, during checking by police was also found loaded with six gunny bags of poppy straw powder (Bhukki) weighing 180 Kg. Police registered a case. Justice Janak Raj Kotwal after hearing Rahul Sharma appearing for the petitioner whereas AAG Seema Shekhar appearing for the state respondent, observed that petitioner allegedly has been found in possession of poppy straw weighing 180 kilograms which is commercial quantity as per the relevant notification under the Act. Under Section 37 of the Act, a person accused of offence under the Act involving commercial quantity of the contraband can be released on bail only if the court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and that he is not likely to commit any offence while on bail and dismissed bail application with the observation that trial court to increase its efforts for expeditious conclusion of the trial.
