Cheaters, fraudsters booked by Crime Branch

Jammu, Nov 16: Crime Branch, Jammu has registered a case FIR No. 37/2013 u/s 419, 420, 423, 465, 466, 467, 468, 471, 120-B RPC against Mohinder Pal Gupta (M.P) S/o Tunda Mal R/o Bikram Chowk, Jammu at present H.No. 10 Khoo Wali Gali, Trikuta Nagar, Jammu, Narinder Kumar Jain S/o Charanjeet Jain R/o 3-Jain Colony Talab Tillo, Jammu, Ashok Kumar Sharma S/o Girdhari Lal Sharma R/o Paloura Janipur, Jammu, Nasir Hussain S/o Bashir Hussain R/o Paloura, Jammu, Varun Mahajan S/o Satish Mahajan R/o 24-Malhotra Street, Jammu and Rajinder Singh Katoch S/o Mast Ram R/o Reshamghar Colony, Jammu for cheating and preparing fake/fabricated documents. Brief facts of the case are that a written complaint was lodged by Sukhvir Kohli with Crime Branch, Jammu alleging therein that he was in search of a plot of land when two persons namely Mohinder Pal Gupta and Sham Singh approached him and offered to sell a plot, belonging to Sham Singh, measuring 2 kanals under Khasra No. 164 situated at Chak Changerwan Tehsil & District, Jammu for sale consideration of Rs 30 lacs which was accepted by the complainant and the payment of Rs 30 lacs was made through Mohinder Pal Gupta to Sham Singh, who in turn entered into an agreement with the complainant to sell the said land after obtaining the entire amount of consideration and also executed an Irrevocable General Power of Attorney which was registered before the Ld. Sub-Registrar-IV (2nd Additional Munsiff), Jammu.
After waiting for a considerable time and despite repeated requests neither the sale deed was executed nor was the possession of the land handed over.
On receipt of this complaint, an enquiry was initiated in Crime Branch, Jammu and during the course of enquiry, it was found that accused Varun Mahajan who was well known to the complainant, introduced accused Mohinder Pal Gupta (M.P) and Narinder Kumar Jain with the complainant with the offer of a plot under Khasra No. 743/min situated at Lower Muthi, Jammu, which was accepted by the complainant for a sale consideration of `Rs.8.90 lacs and in this regard accused Mohinder Pal Gupta executed an agreement to sell after receiving an advance payment of Rs.3.50 lacs in presence of accused Varun Mahajan, however, despite repeated requests the possession of the said plot was not handed over to the complainant.
Accused Mohinder Pal Gupta and Varun Mahajan again approached the complainant and allured him through a power of attorney dated 15.11.2006 executed between Sham Singh and Narinder Kumar Jain pertaining to land measuring 2 kanals under Khasra No. 164 situated at Chak Changerwan, Jammu and succeeded in entering into a deal which was bonafidely accepted by the complainant who paid the total amount of Rs 30 lacs as sale consideration, which included Rs 12 lacs in cash and Rs 18 lacs on account of transfer of his plot bearing No. 720 situated at Sector 'C' Sainik Colony, Jammu in favour of one Bua Ditta, and in this regard accused Mohinder Pal Gupta executed an agreement to sell after obtaining the entire amount of consideration and also executed an Irrevocable General Power of Attorney.
Whereas, accused Mohinder Pal Gupta was not at all empowered to execute these documents. It was also found that the Power of Attorney executed by Sham Singh, the original owner of the land in favour of Narinder Kumar Jain was revoked by a deed of revocation duly registered before Sub-Registrar, Jammu and that one Rajinder Singh Katoch S/o Mast Ram R/o Reshamghar Colony, Jammu had impersonated as Sham Singh in the court at the time of registration of the document executed by accused Mohinder Pal Gupta.
From the aforementioned facts, it spells out that the accused persons with malafide intentions hatched a criminal conspiracy and prepared/executed fake/fabricated documents by resorting to fraudulent means and impersonation, thereby causing wrongful loss to the complainant and wrongful gains to themselves on this a formal case has been registered and investigation started.
