| Prosecution failure leads to acquittal of Narco smuggler | | | Early Times Report
Poonch, Nov 23 (JNF): A local court on Saturday acquitted a person, who was facing trail in smuggling of charas as the prosecution miserably failed to prove the case. The acquitted person has been identified as Abdul Hamid son of abdul Rahim resident of Rajdhani tehsil Thanamandi district Poonch. After hearing both the sides, Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that it has also been brought to the knowledge of the Court that all the prosecution witnesses examined in the instant case are police officials and the single civil witness examined by the prosecution has not supported the prosecution at all. The other important witness has stated that at the time of the search there were a number of people on spot and the traffic was also on the road. Besides this, according to him, there were residential houses near the place of occurrence but no independent witness was called. This prosecution witness has even stated that the persons in whose presence the Charas was seized were not kept as witness. He is also surprised to see that the first seizure memo of the Charas prepared by him has not been shown to him in the Court. It is thus evident that public witnesses were available and could have been associated to witness the search and recovery and even those persons who had seen the recovery as per one of the prosecution witness have not been cited or examined by the prosecution and no explanation on these lines is forth coming which also make the prosecution case doubtful. With these observations Court acquitted the accused from the charges leveled against him. |
