| Court awards six years imprisonment to accused | | | JAMMU, Nov 29 (JNF): Principal Sessions Judge Kathua A.K.Koul today awarded 6 year imprisonment to Ravinder Singh who was facing trial in attempt to murder case for last 10 years and acquitted his brother namely Hari Singh from the charges. Genesis of prosecution case lies in the statement Chandu Ram victim of alleged murderous assault. The statement being of essence deserves a brief reproduction. The victim alleges that the accused forcibly occupied his land, which forced him to lodge an FIR against them. It was on 28-10-2003, he was on way back to his home when both the accused, who had laid an ambush, came out of the bushes and waylaid him. After completion of the investigation challan was presented in the court.Principal Sessions Judge Kathua AK Koul today after hearing Public Prosecutor Ravi Gupta for the state whereas Adv AS Salathia for the accused observed that The Ravinder Singh had the opportunity and occasion to inflict fatal injuries to the victim which could even cause his death but it appears that he never intended to kill. He is, accordingly, convicted U/Ss 325/324 RPC r/w Section 4/25 Arms Act. Hari Singh is, however, acquitted of all the charges and sentenced Ravinder Singh and awarded him to imprisonment for four years and a fine of Rs. 5000. Similarly, he is sentenced to imprisonment for one year for commission of offence u/s 324 RPC. The accused No.1 would also undergo an imprisonment of one year and a fine of Rs.2000 for the commission of offence u/s 4/25 Arms Act.
