Accused acquitted in wife’s abetment to suicide case

JAMMU, Nov 29 (JNF): Principal Sessions Judge Jammu Kartar Singh today acquitted one Manmohan Singh who was facing trial in much publicized abetment to suicide case of lecturer Iqbal Kour (wife of the accused) as prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt.
After hearing both the sides, Principal Sessions Judge Jammu Kartar Singh observed that The case is pending disposal since 6.6.2005 but during this period, the prosecution could not produce all the witnesses in order to connect the accused with the commission of alleged offence and held that prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt.
According to the police case, on March 14, 2005; an information was received in the Police Post Panjthirthi on telephone that one lady Iqbal Kour was admitted in the hospital as a case of poisoning and on this information Abdul Latief Head constable visited the hospital but the injured was not in a position to give a statement and ultimately she died.
Thereafter FIR for the commission of offence u/s 306 RPC was registered and investigation ensued. During investigation, it was found that the marriage of the accused was solemnized with the deceased Iqbal Kour at Jammu and at that time she was posted as lecturer in a Govt. College Poonch. She after her transfer from Poonch to Jammu in the month of November 2004, started living with the accused at her matrimonial home situated at Karan Nagar Jammu in a joint family comprising of her sister-in-laws, their husbands and children.
Deceased was blessed with a daughter during her posting at Poonch. Accused on the instigation of other accused namely; Kamaljit Kour and Harjeet Kour (since discharged) used to beat the deceased on petty matters and he was having illicit relations with Harjeet Kour. She was taken to the hospital but on the morning of 14.3.2005, she breathed her last. After investigation, the final report was submitted against all the three accused in the court.
