Court acquits ex-Director Health, SO from charges
Major set-back to SVO

Jammu, Nov 29 (JNF): Additional Sessions Judge Anticorruption Jammu Sanjay Parihar today discharged Dr. Mohan Parkash Gupta then Director Health Services Jammu, Sham Lal then SO, Pawan Kumar Bakshi then Senior Assistant DHS Jammu and Tarsem Lal & Yash Pal Beneficiaries at the stage of framing charges as the VOJ failed to prove the charges leveled against them.
Hence, no case for framing of charges u/s 5(1) (d) 5 (2) Of J&K PC Act r/w section 120-B disclosed against alleged accused persons charges against them is found to be groundless on the basis of material collected so far. They are discharged of alleged offences. While discharging the then Director Health Services Jammu & ors, Additional Sessions Judge Anticorruption Jammu Sanjay Parihar observed that in case the vigilance organization is interested to pursue the matter further, present order shall not come in their way.
Any observation made shall have no effect on such further investigation, if any undertaken. Court further said that in that eventuality VOJ shall be at liberty to obtain record of the case besides all the alleged accused persons shall also render all possible assistance thereto in culmination of such investigation.
According to the VOJ case that then Director Health Services abused of his official position in furtherance in criminal conspiracy with accused Sham Lal Section Officer and Pawan Kumar Bakshi Senior Assistant of his office without obtaining list of deserving candidates of Safaiwalas from his subordinate units and without proper verification of his record illegally issued regularization order in respect of Tarsem Lal and Yash Pal.
Infact as per record seized from the Health Dept One Koushaliya Devi and Santosh Kumari has been working as part-time safaiwalas in block Bishnah but ignored their rightful claim for regularization and instead regularized Tarsem Lal and Yash Pal vide office order dated January 6, 1998. Both these individuals were never existing on the roll of health dept nor working as part-time safaiwalas prior to their regularization.
Despite having been informed by Zafar Ali Chib then BMO Bishnah about the both the beneficiaries not being on the roll of Health Dept and this Could not be regularized but his request fell on deaf years and no corrective measures were taken-up by the accused persons and VOJ registered a case under FIR NO 16/1999 and after completion of investigation presented challan in the Court.
