Prosecution failure leads to acquittal of 3 cheats

Jammu, Dec 18 : Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Master Abdul Qayoom and Fareed Ahmed who was facing trial in allegedly making ScheduleTribe Certificate and Residents of Backward Area Certificates as prosecution failed. According to the police casea report lodged by Tehsildar Mandhar vide letter No. JC/93-95 dated 17.10.2003 addressed to the SHO Police Station Mendhar with averments that Kafeel Ahmed S/O Mohd Alam R/O Village Kalaban Tehsil Mendhar produced photostat copies of Schedule Tribe Certificate and Residents of Backward Area Certificate for attestation. On checking of it was found that those certificates were faked. The beneficiary of the certificate present in his office has stated that Abdul Qayoom S/O Manzoor Ahmed S/O Village Kalaban got him issued these certificates. On this FIR No. 137/2003 for offences u/s 420/467/468 RPC was registered and the investigation was entrusted to Rashid Ahmed Khan ASI. During the course of investigation Kafeel Ahmed was arrested, seizure memo was prepared, statement of witnesses u/s 161 CrPC were recorded. During the course of investigation Kafeel Ahmed was found innocent but the accused Master Abdul Qayoom and Fareed Ahmed were found committing fraud by issuing forged certificate of Schedule Tribe, Backward Area by preparing them. After completion of investigation challan was presented in Court. After hearing both the sides, Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that the prosecution has failed to connect the accused Abdul Qayoom and Fareed Ahmed with the commission of the offence attributed to them.
The result is that the accused Abdul Qayoom and Fareed Ahmed are acquitted for the offences with which they have been charged. (JNF)
