Jammu, Dec 19 (JNF) : Principal Sessions Judge Jammu Kartar Singh has awarded five years rigorous imprisonment and fine Rs 10,000/- to Mohd Saleem Khan facing trial for attempting to fudging of evidence in minor's death case. Principal Sessions Judge Jammu Kartar Singh after hearing both the sides observed that offence under section 201/511 RPC has been proved against him for which lesser punishment has been provided. The accused is, therefore, sentenced to undergo rigorous imprisonment for a period of five years for the commission of offence falling under section 201/511 RPC and pay a fine of Rs.10,000/-and in default of payment of fine, he shall further undergo rigorous imprisonment for a period of three years. According to the case that investigation revealed that accused Mohd Yousaf on 12/3/03 called Owaise Rashid, deceased, into his house at Bathindi and sodomized him and when Owaise Rashid called for help, the accused strangulated Owaise with a towel resulting victim's death on spot. After that accused cleared the spot and put the body of the victim in the gunny bag and kept it in a store over the bathroom. Later he alongwith his relatives Mohd Saleem Khan and Sohan Lal hatched a conspiracy to destroy body of the deceased. The trio at about 8.45 PM carried the body in a minibus (1973-JK02P) and while going towards Railway crossing, police patrol suspected some foul play and intercepted the matador during checking seized the body. A challan was presented in the Court u/ss 302/377/201/511 RPC. On April 3, 2012 Trial Court awarded death sentence to Mohd Yousuf Shah s/o abdul gani shah r/o Palhel and issued general arrest warrants against Mohd Saleem Khan. Meanwhile High Court in an appeal filed by Mohd Yousuf Khan has modified the death penalty into life-imprisonment. In execution of warrants issued under section 512 Cr.P.C. by this court in the above title case, the accused no.2 Mohd Saleem Khan has been produced in the court to face trial. |
