HC seeks personal appearance of Ex-VC JDA
Residential Area turns commercial complex

Jammu, Dec 21: In a significant order passed by a Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi has taken serious note of the non-implementation of order dated November 10, 2009 passed by then Division Bench headed by then Chief Justice Barin Ghosh and Justice Sunil Hali, by virtue of the said judgment the Jammu Development Authority had been directed to demolish the commercial complex within two years that is by or before November 10, 2011. Since the JDA failed to comply the order, the petitioners OP Bakshi & ors filed a contempt petition against the functionaries of the JDA and after hearing Advocate SK Shukla with Adv Vikas Sharma appearing for the petitioners whereas Adv Adarsh Sharma appearing for JDA, Division Bench after expressing its displeasure observed that order dated November 10, 2009 was to be complied by or before November 10, 2011 but needful has not been done.
Division Bench further observed that a perusal of the file along with arguments submitted by Advocate Adarsh Sharma appearing for Sarita Chouhan VC JDA would reveal that there is hardly any compliance of the order. Upon this Division Bench observed "we find that there is prima-facie case for proceeding against Vinod Sharma then VC JDA", and issued notice for his personal appearance on the next date of hearing. Division Bench further observed that Former VC JDA and presently Director ERA would be allowed to inspect the record of year 2010 which is shown to the Court by the counsel for JDA. JNF
