| HC issues warrant for securing presence of Com Secy H&UDD | | | S Sabaqat
Srinagar, Dec 21 : The J&K High Court has issued a bailable warrant against Commissioner Secretary Housing & Urban Development Department (H&UDD) to secure his presence following non-compliance of its order issued on September 30. The High Court on September 30 had granted time to respondents for filling statement of facts and compliance report by or before November 4, failing which it had directed the Commissioner Secretary H&UDD to appear in person. However, a single bench of the court comprising Justice Ali Mohammad Magrey observed that neither statement of facts /compliance report has been filed nor has the Commissioner Secretary appeared in person. "No option but to secure presence of respondent no.2 (the Commissioner Secretary) by coercive method has been left," the court said and issued the warrant to the tune of Rs 10000 for securing the presence of the Commissioner Secretary. The court was hearing contempt petition titled "Rajinder Kumar Tutoo and Anr Vs Mohammad Iqbal Khanday and Anr. "In their petition, the petitioners have alleged discrimination to them vis-à-vis their promotion as against their junior counterparts. The court had directed the respondents to consider the grievance of petitioners and decide the same under rules within stipulated time. However, the petitioners said that respondents have deliberately ignored the directions by the court."They neither considered our case nor decided their representation," they said, seeking compliance of court direction and framing of rules against respondents for "willful and deliberate disobedience of the court order." |
