| Rape accused acquitted after prosecution failure | | | Early Times Report
Jammu, Feb 8 (JNF): Principal Sessions Judge Bahderwah MK Sharma has acquitted two accused residents of village Inharrah Tehsil Gandoh facing trial for the last six years whereas one of the accused died during the trial. After hearing both the sides, Principal Sessions Judge Bhaderwah MK Sharma acquitted Amresh Kumar S/O Prem Lal and Mst Prem Dai Alias Subhnoo Devi w/o Prem Lal residents of village Inharrah Tehsil Gandoh who were facing trial for the last six years whereas Prem Lal father of Amresh Kumar died during the trial. Earlier Court observed that the evidence collected by the prosecution is not sufficient and satisfactory to convict the accused for the charge framed against them and the challan therefore fails. According to the case that the prosecutrix and the accused persons are neighbor. It is alleged that the accused Amresh Kumar was betrothed to the prosecutrix and under the pretext of proposed marriage, the accused Amresh Kumar have had sexual intercourse with the prosecutrix several times and impregnated the prosecutrix. Thereafter, the accused refused to marry the prosecutrix. On 26/10/06, the prosecutrix filed a written complaint against the accused persons before the Munsiff and on the direction of Court, police registered a case and presented challan. |
