| Moral turpitude: Common minimum factor in J&K Government | | | Early Times Report
JAMMU, Feb 7: To begin with, it was the PDP's legal luminary Muzaffar Hussain Baig who threw a bombshell on the floor of the Assembly, within months of the new National Conference-Congress coalition regime's assuming office, that the names of the Chief Minister and his father had figured in the official documents and statements made during the investigation of the Srinagar Sex Scandal of 2006.Baig could not substantiate his allegation. Omar Abdullah,Chidamdaram said that Omar Abdullah's name had not surfaced anywhere during the investigation conducted by the Central Bureau of Investigation. In the infamous sex scandal most of the accused were taken off the hook when the same characters and witnesses turned hostile who had set the Valley on fire with their serious allegations against the politicians, grabbing the entire front page space of all newspapers for months and wasting the weeks of the courts' work in Srinagar.Neither anybody has questioned the CBI nor has the premier investigation agency clarified of its own why the case of perjury was not filed against the complainant-witnesses for their U-turn, even as their statements had been recorded in camera under section 164 CrPC before the Principal District and Sessions Judge of Pulwama. Even when the Division Bench comprising Justice Bashir Ahmad Kirmani and Justice Hakim Imtiyaz Hussain desired, albeit with a difference of opinion, that the CBI should question 15 more of the accused against whom the investigation had been closed. The court pointed out that the witnesses had made similar statements and allegations against these 15 people which they had leveled against a dozen-odd who had been arrested and jailed. It appeared as if creating the conditions of chaos were part of a larger strategy to facilitate shifting of the case to Chandigarh. On the day of the transfer, many in the State expressed their pessimism and claimed that the matter would be "fully buried" and the accused would be rehabilitated in the "national interest". That is exactly what happened. Even after that, all the matters of moral turpitude were buried for the convenience and comfort of the dubious characters. Two years ago, one of the former MLCs of National Conference was allegedly caught red-handed with a lady anchor of Doodrashan Kendra in Srinagar. FIR was registered and the duo was arrested. They were later given clean chit for reasons that adults could have their wishes. A many beneficiaries of such "clean chits" and the witnesses' turning hostile are well-connected in the current regime. It has become a routine to the extent that, despite Mr Omar Abdullah's opposition, the NC General Secretary Sheikh Nazir has appointed the same ex-MLC as the Block President of his party in Anantnag district. He is now claiming the party's ticket which he is likely to get later this year for the Assembly elections. This kind of a friendly atmosphere must have come handy to the Congress MLA and Minister of State Health Shabir Khan in allegedly thinking of and practicing a sexual assault on a subordinate lady doctor in his office in Srinagar last week. |
