| 3 facing trial in abetting army to fire upon police acquitted as prosecution failed | | | Jammu, Feb 27 (JNF) : Principal Sessions Judge Poonch has acquitted Fazal Ahmed, Mukthiar Hussain and Mohd Ikhlaq who were facing trial in case for abetting the army party to fire upon the police party as prosecution miserably failed. Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that ere is no evidence on record to say that the accused have instigated the army personnel to fire upon the police party with which they have been charged. With these observations Court acquitted the accused as prosecution failed. According to the case that on the morning of 4/8/2006 after spending night in the house of Lal Hussain when Head constable Iftar Ahmed went to the house of the accused persons situated at Ghani Balnoi for enquiry on the application of Lal Hussain and when reached near the house of the accused Army personnel of 10 Sikh Li abetted by the accused persons with intention to kill started indiscriminate firing upon them on which they raised alarm that they are police officials and civilian but army personals continued firing which resulted into injuries to Mushtaq Ahmed whereas constable Showket Ali received grievous injuries. On hearing the firing people came from their houses as a result of which the army personal stopped the firing and left the place. An FIR 112/2006 for offences under sections 307,109,147, RPC and 3/25 Arms Act was registered in Police Station Mendhar and after completion of the investigation offences against the present accused for commission of offences 307/109 were established where as offences under sections 307,109,147,149,RPC and 7/25 Arms Act were established against six army officials against whom separate challan has been produced. Charge for commission of offences u/Ss 307 read with section 109 RPC were framed against each of the present accused persons vide court order dated 18.10.2007. |
