Early Times Report SRINAGAR, Mar 12: A Division Bench of Jammu and Kashmir High Court has directed Crime Branch Kashmir (CBK) to arrest all accused who are evading arrest despite charge sheeted for their involvement in paper selling scam of Common Entrance Test of 2012. "There is no reason CBK to show a lackadaisical approach in execution of warrants against charge-sheeted accused, who are avoiding arrest and against whom warrants of arrest/general warrants of arrest have been issued," the division bench comprising justices Hasnain Massodi and DS Thakur said while hearing a suo-moto PIL. Perusal of status report filed by CBK, the DB observed, would reveal that Investigating Agency has laid charge-sheet against six accused beneficiaries of alleged fraud as also facilitators of alleged crime before Special Judge (Anticorruption), Srinagar. Charge-sheet against 3 juvenile accused (beneficiaries) has been laid before Juvenile Court (Chief Judicial Magistrate) Srinagar. In all, 37 accused figure in two charge-sheets presented before Special Judge (Anti-corruption). "It appears that 20 of 43 accused stand arrested and remanded to judicial custody while 14 accused are avoiding arrest and have been proceeded under Section 512 Cr.P.C, general warrants of arrest stand issued against absconding accused. Arrest warrants against 3 accused stands issued and are under execution." The division bench also asked BOPEE to publish list of 21 candidates, who have a chance to get selected for MBBS Course on the strength of their merit, in wake of cancellation of admission of 21 accused beneficiaries. "It would be only after they signify and convey their intention to seek consideration for admission to MBBS Course that BOPEE would have an opportunity to work out modalities for their admission, identity difficulties that may stand in their way and mechanism to iron out such difficulties," the bench added. |
