| BOPEE scam: Court attaches properties of 7 accused | | | Early Times Report SRINAGAR, May 7: A local court here has ordered attachment of property of seven absconding accused persons, who have gone into hiding to avoid arrest in cash-for-paper scam of Common Entrance Test 2012. The Special Anti-Corruption Court Judge Kashmir M L Manhas issued orders of attachment of the property after hearing a motion moved by Crime Branch of police under section 88 of CrPC. "The warrants of attachment along with the revenue record and report of IO shall be forthwith sent to Executive Officers for execution with the direction that they shall execute the court order without fail and submit the compliance report by or before next date of hearing on 29.5.2014," the court said. The accused include Mohammad Amin Ganie, a resident of Chee Anantnag, Abdul Majid Mir of Wandevalgam Kokernag, Fida Hussain of Kenellwan Bijbhera, Amin Mir of Gulbrag Colony Hyderpora Srinagar, Hilal Ahmad Shokli of Anantnag, Mushtaq Ahmad Kanu of Anantnag and Mushtaq Ahmad Dar of Sandoo Achal. The J&K High Court had last month directed the Crime Branch to take tough action against those avoiding arrest in the case. Hearing a suo-moto PIL, a division bench comprising of Chief Justice M M Kumar and Justice Hasnain Massodi had asked the crime branch for taking the action after Advocate General informed it that despite issuing proceedings against them under section 512 CrPC the accused have intentionally gone into hiding to scuttle the due process of law and also thwart the implementation of the order passed by High Court. The division bench had said there was no reason for the Crime Branch not to make use of tools like proclamation and attachment of property provided under Section 87 & 88 Cr.PC. On April 23, the court had issued written proclamation against the 14 accused including the seven after Crime Branch moved a motion for the same. |
