| HC directs Com/Secy GAD to file compliance or appear in person | | Non-payment of pending wages to XEn | | Early Times Report
Jammu, May 7 : Justice Tashi Rabstan of J&K High Court Jammu Wing today directed Commissioner/Secretary GAD to file compliance for release of back-wages of XEn Rajesh Gupta who was reinstated on the directions of Supreme Court or appear in person. This significant direction has been passed in a petition filed by Executive Engineer Rajesh Gupta who had earlier been compulsorily retired and the Apex Court of India allowed his SLP and quashed compulsorily retirement order with directions to the State of J&K to pay him 30% of back wages and upon non-payment filed a fresh petition. Justice Tashi Rabstan of J&K High Court Jammu Wing today after hearing petitioner in person observed that the officers appeared on behalf of Commissioner/secretary Rural Development Department has produced correspondence dated April 17, 2014 whereby forwarded the representation dated April 9, 2014 submitted by the petitioner with a request to take action at the earliest. Upon this Court directed Commissioner/Secretary GAD to consider and pass consideration order in light of correspondence submitted by Commissioner/secretary RDD within a period of four weeks and file compliance by or before next date of hearing, failing which Commissioner/Secretary GAD shall appear in person in the Court on next date of hearing. |
