| JU's order defies spirit of 'Right to Education' | | | Arun Singh
Jammu, May 22: Jammu University authorities have attracted strong criticisms from socialites and academicians for its order restraining those who have criminal cases pending against them from seeking admissions in its academic departments. Sources said that JU authorities issued the controversial order to deny admission to candidates with criminal background in all its departments and affiliated colleges, unmindful of the fact that the order was not in line with the spirit of education for all. As per the notification vide No. F Acd/14/ 4575-4774 dated 16.05.2014 , at the time of admission to any course/ programme in the University Department/ Affiliated College/ Institution the following are required a) provision/ character certificate issued by the Head of the Institution in which the candidate was studying during the previous year. b) incase a student who has not previously attended any college or institute as a regular student, he/she shall have to furnish a certificate of conduct signed by 1st class magistrate/ principal of an affiliated of constituent college or head of the post graduate department of the university. c) A candidate having any pending case or any FIR registered against him/her has to produce character certificate of the concerned police station/police post. Besides, any candidate having criminal background shall not be considered for admission to any course/programme in a university department of institution affiliated to the university. The legal experts, on being contacted, termed the notification a sheer violation of fundamental rights saying that Clause C of the notification vide No. F Acd/14/ 4575-4774 dated 16.05.2014 is violation of Article 21 (a) of Right to Education of Constitution of India. JU students strongly criticized the controversial order saying that there are many students who have complaints/ FIR against them who participated in Central University agitation, Amarnath Land Row agitation and other agitations for the welfare of the community. They further said that incase a student is involved in criminal activity, JU authority has right to take action against the erring student under the provisions. Even Jammu University Code of Conduct says that any act of violence/ assault/ manhandling/ verbal abuse/ damage to property by any constituent of the University community, in whatsoever form, on the campus shall henceforth be regarded as a serious indiscipline/ misconduct and shall call for immediate following actions, within three days, on being found correct by a preliminary enquiry (i) immediate suspension of the students/employee pending detailed enquiry which shall be completed within working days. (ii) in case of student, the Dean Students Welfare shall maintain a record of habitual offenders and such act for more than three shall be treated a ground of his rustication from the university. Guidelines further said that in case of grave misconduct in the first instance, rustication can be done-on the recommendations of committee. Hence the disciplinary/ competent authority in all above (i) and (ii) shall be the authority as prescribed in the existing rules/statutes/regulations as mentioned aforesaid.
