Jammu, May 22: Crime Branch (CB), Jammu today has produced challan Court of Chief Judicial Magistrate, Jammu against retired Dy SP and SP for misplacement of seized record pertaining fraudulent withdrawal of relief and etc. "Identified namely as S Mohinder Singh son of Madan Singh resident of Gadigarh, Dy SP retired and Sher Ali son of Nizam-ud-Din resident of Bhagyal Kathua SP retired have been booked in case FIR No. 49/2007 u/s 409,201 RPC P/S Crime Branch", CB spokesperson said. He further said that brief facts of the case are that instant case was registered on the basis of the final report submitted by Mushtaq Ahmed the then Inspector Crime Branch, Jammu (now Dy.SP) who in his report submitted vide Nos. CR/MAG/992 dated 19.01.2006 followed by detailed reports submitted in both the cases on 10/02/2007 had mentioned that most of the records seized in the case FIR Nos. 01/1992 and 08/1992 went, and accordingly cases were registered with Police Station Crime Branch, Jammu u/s 420, 467, 468, 471-RPC. "The cases pertain to the fraudulent withdrawal of relief meant for Kashmiri Migrants by some persons in connivance with the staff of Relief Organization as well as various branches of J&K Bank in Jammu city under fake and fictitious names, by different IOs of Crime Branch, Jammu were missing and there is no explanation from any of the investigating officers as to where these records have been placed, on this report, a formal case was registered in Crime Branch, Jammu", he said, adding that on basis of the investigation conducted in the case it is ample clear that the seized record in case FIR No. 1/1992 was properly handed over to Mohinder Singh. The spokesman said, "He (Mohinder Singh) was thus the custodian of this Govt property and was responsible for its safe accounting and custody." "But he failed in his legitimate duties and misplaced/destroyed the records with malafide intention to provide undue benefit to accused person of Case FIR No. 1/1992 as the case was closed as untraced, " he added. "During the course of investigation, the exercise has been done by all means to trace out missing record i.e constituting team for locating missing record from dead stock/malkhana and report of the committee is on record, efforts were made by different I/Os but record is untraced", he said, adding that in this way intention of the then I/O Mohinder Singh is clear. He said that from the investigation conducted in the instant case and relevant document collected it is clear that the then I.O SI Mohinder Singh son of Madan Singh resident of Gadigarh Jammu (now Dy.SP Rtd.) has been found to have committed offence u/s 409/201/RPC. During investigation of the case, the accused persons were found to have committed the offences u/s 409,201 RPC and have accordingly been challaned in the Court of law with the prayer for judicial determination", spokesman said, adding that next date of hearing in the case has been fixed on July 2, 2014. |
