SRINAGAR, May 29: High Court has asked state government not to act on its order regarding transfer of acting Chief Town Planner Kashmir till June 5. Acting Chief Planner Iftikhar Ahmad Hakeem moved High Court with a petition, questioning government order (No. 177-HUD of 201 dated 23th May 2014), whereby he has been transferred and posted as Incharge Chief Town Planner, Srinagar Development Authority. After hearing his petition, a bench of Justice Hasnain Masoodi issued notice to the state government and J&K Public Service Commission. Hakeem is member of Town Planning (Gazetted) Services and is at present posted as incharge Chief Town Planner, Kashmir. He, through medium of writ petition questioned the Government order on the ground that in terms of Rule 27, J&K Civil Services (Classification Control and Appeal) Rules, he can be transferred within Cadre i.e. Town Planning (Gazetted Service) and not against a post not part of the Cadre that too in Srinagar Development Authority. Secretary Housing and Urban Development is said to lack authority to upgrade post of Senior Town Planner in Srinagar Development Authority to the level of Chief Town Planner, as has been done vide order impugned in the petition. "In view of case set up, order No.177-HUD of 2014 dated 23rd May 2014, he shall not be acted upon to the extent it relates to petitioner till next date of hearing before the Bench.,' the court said, and posted the case on June 5. |
