Court awards 8 years RI, fine Rs 20,000 in rape case

LEH, July 1 : Principal Sessions Judge Leh Sanjay Dhar decided a rape case within five months today and awarded eight years rigorous imprisonment and fine Rs 20,000 to Tsering Dorjays/o Tundup Sonam r/o Village Bodhkharbu Kargil who was facing trial in rape case for the last five months.
According to the prosecution case that on January 1, 2014 at about 6:30 PM father of the prosecutrix lodged a report with police alleging therein that a few days back his daughter, the prosecutrix had gone to visit her aunt who is residing in village Ney and on January 29, 2014 when the prosecutrix was returning to her home with her uncle the accused in his vehicle on reaching near Gurdwara committed rape upon her inside the vehicle and thereafter fled away from the spot.
On this police registered a FIR and during the investigation of the case police recorded the statement of prosecutrix in which she stated before the Magistrate that on January 29, 2014 the
she had gone to village Ney to visit her aunt, boarded the car bearing no PB08AJ-5260 with her maternal uncle, the accused Tsering Dorjays and both of them proceeded towards Thiksay Leh. On reaching Gurdwara Patharsahib, the accused drove his car towards Omla road and thereafter parked it at deserted place where-after accused committed rape upon her and after completion of investigation challan was presented in the Court.
Principal Sessions Judge Leh Sanjay Dhar after hearing Public Prosecutor Sanjay Dorjee for the state whereas Adv Gonbo Stobgyal for the accused observed that court found no reason to award lenient punishment to accused particularly he has ravished a young gilr who happens to be his niece and by such an act, the trust and confidence that girl would normally repose upon her close relations has been completely shattered. Court further observed that accused who was supposed to be savior of prosecutrix, has turned out to be her assailant and awarded eight years rigorous imprisonment and fine Rs 20,000. Court further said that in the event of recovery of amount of fine a sum of Rs 15000/- out of the same shall be paid to prosecutrix by way of compensation. JNF
