| HC stays suspension of license of JK Medicity | | Alleged medico negligence | | | Jammu, Aug 4: In a petition filed by S Gaganpreet Singh Managing Director JK Medicity Hospital Pvt Ltd challenging the suspension order dtd July 27, 2014 whereby registration has been suspended with immediate effect, the J&K High Court wing stayed the order and directed Director Health Services (DHS) Jammu to constitute a committee in this regard that shall file its report within a week's time. After hearing Sr. Advocates PN Raina & Sunil Sethi with Advocates J A Hamal appearing for the petitioner, Justice Tashi Rabstan of J&K High Court Jammu Wing issued notice to Chief Secretary and Director Health Services Jammu. Meanwhile Sr AAG Gagan Basotra accepted notices and seeks weeks time to file response in the petition. Earlier Justice Tashi Rabstan observed that subject to objections from the other side and till next date before the Bench, order impugned dated July 27, 2014 shall stay. Court also directed Director Health Services to constitute a committee within two days from today, which shall file its report within a week's time. Thereafter, Director Health services shall file compliance before the Court on the next date of hearing. Petitioner had submitted that the order impugned dated 27/07/2014 has been passed in terms of Section 5, Sub-section (iii) and (iv) and Section 6 (1) under Chapter-II of J&K Nursing Homes and Clinical Establishment (Registration) and Licensing) Act, 1963 by which registration granted to M/s. Medicity Hospital Pvt. Ltd has been suspended with immediate effect. Here it needs to mention that a doctor and a Female Health Worker of the Hospital were arrested for their negligence in performing their duties which resulted into death of foetus due to administration of abortion medicines.
