DB grants two days time for filing report regarding appointment of Judges in SAC

Jammu, Aug 11: In the much publicized Public Interest Litigation (PIL) initially filed for seeking sanction in corruption cases wherein IAS/IFS/KAS officers and a fresh application highlighting inadequate staff/ infrastructure at anti graft bodies including State Accountability Commission (SAC) , State Information Commission (SIC) and State Vigilance Commission and newly created seven Additional Anticorruption Courts in State of J&K, a Division Bench (DB) of State High Court granted two days time for filling response regarding appointment of Chairperson and Members of SAC.
When the matter was taken-up today for hearing, Sr. Additional Advocate General Gagan Basotra appearing for the State, stated that he may be given just another two days time to file report. Upon this Division Bench comprising Justice Virender Singh and Justice Tashi Rabstan granted two days with the direction to Sr. AAG that he make it clear that a detailed response is also required to be filed pursuant to the observations made in Para 9 of Order dated July 8, 2014 whereby the Division Bench on July 8, 2014 on the issue of appointment of two Former Judges to the Accountability Commission. The Division Bench also referred that in its order dated July 8, this year it was submitted to court that both the Chairman and the Member, are to complete their terms in August, 2014 but there is no information, about any step taken regarding filling up two positions by constituting a Search Committee. Accordingly, Court had directed that immediate steps be taken for appointing the Chairman and Member of the Accountability Commission and a detailed action taken report shall be filed by the Department of Home, law and General Administration before the next date of hearing. Division Bench today after hearing both sides granted two days time to file report and directed Registry to list this PIL on August 14, 2014. (JNF)
