| 10 years RI to two Teachers for raping minor students | | |
Jammu, Sept 26: Principal Sessions Poonch Jaffer Hussain Beigh today awarded 10 years rigorous imprisonment and fine Rs 10,000 each to two teachers namely Shahzad Alam S/O Mohd Alam and Ghulam Mustafa S/O Mureed Hussain Both residents of Village Fazlabad and acquitted Mohd Ayub as prosecution failed to prove charges against him. Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing both the sides observed that trial in this case has taken about seven years and the accused during this period were in custody but both the accused were teachers and they have been convicted for committing rape upon their own minor students. As there was a fiduciary relationship between the accused and the minor prosecutrix being in their custody and they were trustees, it became a case where fence itself eats the crop. For these reasons I sentence each of the accused, namely, Shahzad Alam and Ghulam Mustafa to undergo rigorous imprisonment for ten years and to pay a fine of Rs.10,000/- and in default of payment of fine shall further undergo imprisonment of like nature for 6 months for the commission of offence under section 376(1) RPC and to undergo rigorous imprisonment for six months and to pay a fine of Rs.500/- and in default of payment of fine shall further undergo imprisonment of like nature for two months for the commission of offence under section 342 RPC. Both the sentences shall run concurrently. |
