Jammu, Nov 1: Principal sessions judge, Jammu, R S Jain today discharged a narco-smuggler at the time of framing charges as the prosecution failed to prove the case. According to the police case, Bahu Fort police recovered 100 bottles of corex, 715 tablets of Anzilum O.S, 240 tablets of Corisoma and 216 capsules of Spavas Parivon from possession of Romesh Kumar of Rehari Colony on June 19 last. Accordingly, he was arrested and booked under section 8/21/22 NDPS act. The judge, after hearing the two sides, observed that there was no evidence on record more so the report of the public analyst to show that the articles allegedly recovered from the possession of accused contained drugs which violates the provisions of NDPS Act. From the date of filing the challan till date, prosecution had been unable to file the report of the FSL which would show that the articles seized from possession of accused contained drugs so as to make out a prima facie case against him for offences under the NDPS Act and thus the allegations against the accused are based on conjectures and surmises which have no basis. Hence the accused is discharged, the judge ordered. (JNF) |
