Bail denied to 3 accused in attempt to murder case

Jammu, Feb 23: District Mobile Magistrate Kathua Munish K Manhas rejected bail application of 3 accused persons in case FIR No 32/2018 u/s 307 , 341, 147, 148 RPC and 4/25 Arms Act of PS Kathua who were allegedly involved in a criminal conspiracy along with a lady doctor to eliminate her husband, Naresh Kumar.
According to police case on 19-01-2018 Naresh Kumar R/o Krishna Colony Kathua while he was returning on Scooty from the ultrasound centre of his wife along with his domestic helper, he was assaulted by 6/7 persons who were armed with tokas and lathies and they made a murderous assault on him causing multiple injuries on his head and other parts of body when hue and cry was raised, some persons came on spot and assailant fled leaving motor cycle bearing registration no.PB06AC-9496 on spot. Subsequently FIR no. 32 of 2018 for offences
Under sections 307, 341, 147, 148 of RPC and section 4/25 Arms Act was registered and investigation began. During investigation, four accused including petitioner who is wife of injured were arrested and it revealed that because of strained relation with her husband, the lady doctor asked accused Joginder alias Happy who was an employee in her ultrasound centre to do away with her husband. Subsequently, a criminal conspiracy was hatched which was allegedly masterminded by wife of the injured to eliminate him and occurrence took place. While rejecting the bail application of accused persons, court observed that prima facie material in support of allegations leveled against the accused persons. There is good prima facie evidence that the accused persons have committed the offence punishable with imprisonment for life and three accused are still at large and statement of the injured is yet to be recorded. With these observations court rejected the bail application State was represented by CPO Vikrant Sharma and PO Sidhant Vaid.
