DB directs PCB to carry out inspections

JAMMU, Mar 1: A Division Bench of Jammu and Kashmir High Court comprising of Justice Badar Durez Ahmed (Chief Justice) and Justice Sanjeev Kumar while hearing the petition filed by the inhabitants of Village Mavelkote seeking instruction restraining the respondents to set up the industrial unit in the village as a threat to the environment, has directed the J&K State Pollution Control Board to carry out inspections from time to time to ensure that the conditions stipulated are complied with or not.
Counsel for the respondents submitted that the supplementary affidavit on behalf of respondent No.6 is on record and along with the said supplementary affidavit, a copy of the consent order dated 22.12.2017 issued by the J&K State Pollution Control Board has been annexed.
DB after perusing the consent order observed that No objection has been granted for the period up to August 2018. However, the same is subject to a series of conditions which are laid out in the consent order itself which require strict adherence to the provisions of the Environment Protection Act and the other statutory provisions and rules including the Solid Waste Management Rules and the Plastic Waste Management Rules.
DB viewed that the above said stipulations are adequate provided they are monitored by the J&K State Pollution Control Board. For this purpose, the J&K State Pollution Control Board shall carry out inspections from time to time and at least twice before the next date of hearing. DB directed that after the inspections, the report may be submitted by the J&K State Pollution Control Board as to whether the conditions stipulated are being complied with or not, with data.
