Petition seeking absorption as SG constables
HC directs Home department to decide representation of petitioner within month

JAMMU, Mar 3: A Single Bench of Jammu and Kashmir High Court has directed the Home department to decide representation by one Arjun Dev regarding absorption/induction in Ministerial Executive Cadre as Selection Grade Constables.
In this writ petition, the petitioners inter alia have prayed for command and direction to the respondents to issue orders of said absorption/induction of the petitioners in Ministerial Executive Cadre as Selection Grade Constables (M) in the Pay Scale of Rs.4200-75-5328, by the issuance of writ, order or direction in the nature of Mandamus and command and direction to the respondent to decide the representation filed by the petitioner before the respondents, by the issuance of writ, order or direction in the nature of Mandamus. When the matter was taken up , learned counsel for the petitioners submitted that with regard to their grievances, the petitioners have submitted a representation to respondent No.2 and the aforesaid authority be directed to decide the representation submitted by the petitioners by a speaking order within fixed time limit in the light of order dated 20.11.2017, passed by the Coordinate Bench of this Court in SWP No.1043/2008, titled Sanjay Kumar and Anr. Vs State of J and K and ors. On the other hand, learned Senior Additional Advocate General submits that suitable action in accordance with law shall be taken. Justice Alok Aradhe disposed of the petition in view of the aforesaid submissions and in the facts of the case and directed the Police Department to decide the representation submitted by the petitioners by a speaking order within a period of two months from the date of receipt of a certified copy of the order passed, in the light of order dated 20.11.2017, passed by the Coordinate Bench of this Court in SWP No.1043/2008, titled Sanjay Kumar and anr. v. State of J and K and ors.
