Jammu, Mar 9: In a Public Interest Litigation filed by Adv Rajinder Singh Jamwal highlighting the poor working of State Pollution Control Board (SPCB) and absence of pollution check at government laboratory level, a Division Bench of State High Court Comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar , expressed displeasure over lack of funds. Division Bench observed that on going through the said affidavits, this Court observed that major ground given for the non implementation is the lack of funds. Division Bench questioned why the concerned Department does not make the requisition for adequate funds when the budgetary exercise is done. It cannot be the case for the Government that they need not provide funds for activities which are mandated by the statutes and the statutory rules. Division Bench is of the view that the duty cast on the officials and the Government by the legislation has to be carried out. Because, that is a statutory duty and based on that statutory duty, the citizens have a statutory right seeking directions for fulfilling the duties if the Government takes the excuse of lack of resources. Division Bench after going through the status report observed that the dumping of solid waste at Kot Bhalwal has been initiated and the dumping at the site near the Airport has been stopped.
Division Bench observed that the Committee has been given the mandate to formulate an appropriation action plan for e-Waste Management in Jammu City and the report is to be submitted within two months. Consequent to the constitution of the said Committee, the Additional Deputy Commissioner (Admn) has been appointed as a Member of the Committee. One expert has also to be nominated which shall also be done within a week. A report pertaining to the e-Waste Management Plan is to be submitted by the Committee within the prescribed time frame of two months.
