CJM rejects bail in kidnapping case

Jammu, Apr 27: Chief Judicial Magistrate Jammu Ashwani Sharma rejected the bail application of Jawahir Lai Pandit who was booked by the police in kdinapping of a minor.
While rejecting bail application CJM Jammu after hearing CPO Ashish Rathore with Senior Prosecuting Officer Rohit Gupta and Prosecuting Officer Arvind Manhas for the state whereas Adv Vinod Wali for the accused observed that bare perusal of the police report transpires that the occurrence is alleged to have been taken place on 11.04.2018. The accused is involved in case FIR No.121/18 P/S Domana, Jammu for the commission of offences U/S 363 RPC. The accused is in police custody from 13.04.2018. The statement of the prosecutrix U/S 164-A Cr.P.C has been recorded. The prosecutix has shown her date of birth in her statement U/S 164-A Cr.P.C as 04.11.2000. Thus on the date of the commission of occurrence the prosecutrix was minor. The accused has committed an offence against the minor female which is against the larger interest of the public and the prosecutrix in particular. The offence of kidnapping is a heinous offence is the society particularly against the women folk. The accused as such, does not deserve any concession of bail at this stage, CJM said.
