Jammu, May 17: Violating Supreme Court order on ban on reservation in promotion, the PW (R&B) Department has allegedly been promoting Reserved Category employees to the post of Executive Engineers despite being juniors to the General Category employees and an official very close to the Minister is playing instrumental in illegal promotions.
Sources told Early Times that the department Reserved Category incharge AEEs with Diploma holder are being promoted to the post of Executive Engineers (Civil) in violation of judgments and also ignoring the recruitment rules.
"36 posts of Executive Engineers Civil are lying vacant in R&B Department since long and the Government is not filling up these posts in spite of the court orders for strict implementation of Jammu and Kashmir Engineering Services Gazetted Rules 1978 read with SRO 297 of 2006, where in 80% of the posts are to filled among eligible degree holders engineers and 20% among three years diploma holders of the available posts," they said.
They further informed that Works Department with some vested interests are promoting the junior most diploma holders only against the quota of general category from the reserved category diploma holders who are otherwise are subjected to revert to the original status of Junior Engineer as per directions of High Court of Jammu and Supreme Court.
They further informed that as per J&K Engineering (Gazetted) Service Recruitment Rules, 1978 read with SRO 297 of 2006 dated 14.09.2006 whereby ten years of Gazetted Service is essentially required for diploma holder AEEs so as to become eligible for promotion as Executive Engineers (Civil) whereas the reserved category diploma holder AEEs, who are being promoted are far Junior to their counterparts in General Category as per the seniority list bearing No. PWD(R&B) G/5/2011-1 dated 03.01.2018 and the degree holder AEEs have rendered more than 17 years of Gazetted Service out of which more than 14 years as AEE and have the preferential claim for promotion.
