| SRO 219 yet to be implemented fully | | Women empowerment? | | Early Times Report
Jammu, May 26: Authorities in J&K appear reluctant to take SRO 219, which empowers women, seriously as it's yet to be fully implemented across the state.
On May 12, the Mehbooba Mufti-led government announced that women will not have to pay stamp duty on property purchase. The Finance department had issued notification and its copies were sent to judiciary as well as all administrative departments vide order No.ET/Estt/81/2018, dated: 18-5-2018, mentioned here that SRO 219 in exercise of the powers conferred by clause(a) of section 9 of the Stamp Act Svt. 1977 (Act No.SL of 1977) and in supersession of notification SRO 152 of 2010 dated 31-03-2010.
The government also directed that there will be 100 percent remission of stamp duty leviable under the said Act on land or estate, on its purchase in the name of a female member of the family.
Pleading anonymity, a lawyer said that despite direction of government, the authorities are yet to fully implement the SRO. In few courts where the presiding officer has started registration as per SRO and rest of others is still registered property in the name of female member of the family as per previous SRO.
"No doubt it's a welcome step. The move will help women scale up the social ladder in state. Women across state welcomed the decision made by Chief Minister Mehbooba Mufti to approve zero percent stamp duty on the purchase of property by them", the lawyer said, adding that the cabinet also approved stamp duty of five percent for buyers in urban areas and three percent in rural areas, which was earlier seven and five percent.
The lawyer further said, "Mehbooba Mufti claimed that the incentive will attract families to register their immovable properties in the name of mothers, wives and sisters.
But it can prove beneficial only when it's fully implemented on the ground." |
