Show cause notice issued to DG Prisons
Shifting of under trial from Kot Bhalwal

Jammu, June 7: The First Additional Session Judge Jammu, MS Parihar, has issued a show cause notice to Director General Prisons, Dilbagh Singh, asking him to explain why proceedings be not initiated against him in the case of shifting of an under trial prisoner.
Ravinder Singh, the under trial prisoner, was shifted from Kot Bhalwal jail to Reasi and later to Hira Nagar jail in violation of the court order. Ravinder in his petition filed through advocate Koshal Parihar said that despite court dismissing the application filed by the prison authorities, the DG Prisons ignored the order dated 20-11-2017. Ravinder was shifted from Kot Bhalwal jail to Reasi jail thereby lowering authority of the court "in a very scandalous manner, which is criminal contempt under the contempt of courts Act, 1974." "That the orders passed by this court in terms of section -334 of Cr.P.C are not any administrative or ministerial order but a judicial order and no executive has power to override the same except the higher judicial authority under law, which in this case is High Court. Dilbagh Singh, DG Prisons, transferred the applicant from one jail to another when the request for transfer of the applicant from one jail to another was rejected by the court on 20-11-2107", reads the petition.
Hearing the petition, the First Additional Session Judge Jammu, MS Parihar, issued a show cause notice to Dilbagh Singh, asking him to explain why proceedings be not initiated against him in the case. Next date of hearing of the case has been fixed on 30-06-2018.
