Gross violation of J&K RTI Act regarding free ration supplied in 2014 floods
Rs 25,000 to be recovered from Assistant Director

srinagar, July 25: The Director Food Civil Supplies & Consumer Affairs Kashmir division (FCS &CA) has issued a formal order directing the Assistant Director of his department presently posted in Ganderbal to deduct Rs 25,000 from his salary as he has grossly violated the J&K RTI Act 2009. The officer who is to be penalized is the DDO of the department in Ganderbal district we well. The order of Rs 25,000 penalty was issued by State Information Commission (SIC) after the officer was found to have withheld information pertaining to supply of free ration during 2014 floods in Beerwah area of district Budgam.
Details available with Early Times reveal that one Mujtaba Bashir a volunteer associated with Jammu & Kashmir RTI Movement filed an application udner J&K RTI Act 2009 before Assistant Director FCS &CA Budgam last year asking him details of ration supplied to some stores in Beerwah area. The RTI activist alleges that lot of free ration was sold in black-market by the officials of the department. The information was withheld and Mujtaba filed a complaint before the then State Chief Information Commissioner (CIC) Khurshid Ahmad Ganai who is now posted as Advisor to Governor of J&K. After following the due process of law, State Information Commission (SIC) vide its order SIC /K/Comp/09/2017 Dated 23.5.2018 found the officer namely Ali Mohammad Mir the then Assistant Director FCS & CA Budgam guilty of violating the provisions of J&K RTI Act 2009. The Commission directed the Director FCS &CA Kashmir to deduct Rs 25,000 from his salary as penalty amount. The Director vide his letter No: DFCS&CAK/Adm/B-X-347 Dated: 16.07.2018 directed the officer (Assistant Director Ganderbal) to deduct Rs 25000 from his salary . The officer incidentally happens to be drawing and disbursing officer (DDO) of his department in Ganderbal district as well.
The order of the Director FCS &CA Kashmir reads as:
"Please refer copy of order under section 17 of J&K RTI Act 2009 issued by J&K State Information Commission (JKSIC) where-under penalty of Rs 25,000 (Twenty Five Thousand Only) has been imposed upon you (the then Assistant Director Budgam) by Chief Information Commissioner . As such you are advised to deduct the said penalty amount from your salary and remit the same to the appropriate Government head account"
Meanwhile Jammu & Kashmir RTI Movement has hailed the decision of the State Information Commission (SIC). Founder & Chairman RTI Movement Dr Raja Muzaffar Bhat said that as a citizen he is not happy to see officer of state being penalized but if this is not done the State Information Commission (SIC) will be redundant and officers will take RTI Act very casually. He appealed PIOs to adhere to the provisions of RTI law. RTI Movement has congratulated former CIC Khurshid Ahmad Ganai and Information Commissioner MA Mir for doing great work towards RTI implementation in state.
