JAMMU, Nov 27: In a Public Interest Litigation filed by All Jammu, Kashmir & Ladakh Teacher Federation seeking direction to State for framing policy for maintaining student-teacher ratio in the schools without any discrimination and implement the same in true letter and spirit, a Division Bench of State High Court Comprising Justice Rajesh Bindal and Justice Tashi Rabstan after hearing Adv Pranav Kohli for the PIL whereas AAG Ravinder Gupta for the State, directed Secretary to Government, Education Department to comply with the direction of the Court or appear in person on next date of hearing.
Division Bench observed that on 24th July, 2018, the case was adjourned at the request of Additional Advocate General seeking four weeks' time to enable him to file status report with regard to the infrastructure in the Schools, including Primary and Upper Primary Schools, which are situated in the Rural and Urban Areas. The matter was directed to be listed on 7th September, 2018.
DB further observed that on 12th November, 2018, further time was sought to comply with the order dated 24th July, 2018. On the said date, the respondents were directed to file status report under the signatures of the Secretary to Government, Department of Education, stating therein the period during which the facilities for education shall be ensured to the children in the State, but till date, the said order has not been complied with and more time is sought to do the needful.
Upon this Division Bench directed on failure to comply with the order dated 24th July 2018, the Secretary to Government, Education Department to remain present before this Court along with complete record.
