Srinagar, Jan 5: After tendering apology to the State Information Commission (SIC) for violating provisions of J&K RTI Act 2009 an Executive Engineer (Xen) working with Srinagar Municipal Corporation (SMC) was given a chance to rectify his attitude and his penalty proceedings were subsequently dropped.
While disposing of the 2nd appeal titled Abdul Majid Gagroo V/s PIO/Executive Engineer, City Drainage Division SMC Srinagar dated 14.08.2018, the Registry was directed by SIC to issue a show cause notice to the then PIO/ Executive Engineer, City Drainage Civil Division, SMC, Srinagar, directing him to explain within three weeks as to why the information has not been provided to the then RTI applicant Abdul Majid Gagroo within the period specified under Section 7(1) of the J&K RTI Act.
The penalty proceedings under Section-17 of the J&K RTI Act, 2009 against the then PIO/ Executive Engineer, City Drainage Civil Division, SMC, Srinagar namely Imtiyaz Ahmad Qazi came up for hearing before SIC on 12.12.2018.
Imtiyaz Ahamd Qazi, Executive Engineer, City Drainage Civil Division, SMC, Srinagar attended the proceedings in person before Information Commissioner Mohammad Ashraf Mir.
SIC held : "Commission while going through the said statement filed by the PIO is satisfied with submissions made therein by the PIO explaining the cause of delay for the delay caused in furnishing information to the then RTI Applicant Sh. Ab. Majid Gagroo.
The commission accepts the apology tendered by the then PIO in this regard.
Accordingly, the penalty proceedings initiated against the then PIO/ Executive Engineer, City Drainage Civil Division, SMC, Srinagar, Mr Imtiyaz Ahmad Qazi are dropped with an advisory to the then PIO to be cautious in future and deal with the RTI applications promptly in accordance with the provisions of the RTI Act.
