Jammu, Feb 6: The Executive Engineer (Xen) Pradhan Mantri Gramen Sadak Yojna (PMGSY) Mahore Resai has disrespected the orders of the State Information Commission (SIC) by not calling the information seeker for inspection of documents under the provisions of J&K RTI Act 2009.
The SIC on Jan 11th 2019 had directed the Xen who is also the designated Public Information Officer (PIO) to allow the inspection of the documents within a week. When the information seekers husband was contacted on his phone by Early Times , it was revealed that Xen has not at all called him or his wife inspite of the SICs orders. The information seekers husband also said that SIC order is yet to reach to his wife
Details available with Early Times reveal that an RTI application was filed by one Masoom Bano W/O Mohammad Ayoub Ayan R/O Mahore Reasi on 09.06.2018, seeking some information from PIO/Executive Engineer, PMGSY, and Division Mahore. As there was no response from PIO, information seeker filed 1st appeal on 09.07.2018 before the SE, PMGSY who is the First Appellate Authority (FAA)
"Vide Interim Order dated: 04.12.2018, the appellant was directed by this Commission to visit the office of the PIO within 15 days. The PIO was also directed to facilitate inspection of records by the appellant by showing all the relevant files to her and allowing her to take notes or providing of copies of the documents as she may identify/specify after having such inspection. The appellant did not turn up for inspection of records nor contacted the PIO for such inspection. Since the maximum period available to the Commission in terms of section 16 (11) for deciding an appeal filed under section 16 (4) is expiring, no further adjournment can be given in the present case," reads SIC order
The SIC disposed off the petition with a direction to the PIO to contact the appellant on the Mobile Number given by her in her RTI application and intimate a date on which the appellant would inspect the records. "The appellant is also directed to avail the opportunity of inspection of records. If the appellant chooses to avail the opportunity of inspection, the PIO shall facilitate such inspection by showing all relevant records to her and by providing the copies as may be required by her after such inspection. The PIO shall contact the appellant on phone within a period of one week from the date of receipt of this order and the appellant shall avail the opportunity of inspection within a week after being contacted by the PIO."
