Complaint against Mehbooba for seditious tweet

Jammu, Apr 12: Jammu-based eminent social activist Sukesh c. Khajuria has filed a complaint against former J&K Chief Minister and president of people's democratic party (PDP) Mehbooba Mufti with District Magistrate Jammu, Ramesh Kumar.
Sukesh C Khajuria , member of prominent citizen's Advisory committee constituted by J&K Government has sought legal action against former chief minister Mehbooba Mufti for her seditious tweet dated April 08 , 2019 which has been made Solely to destabilized India.
Mehbooba Mufti, PDP Chief & Ex. Chief Minister of J&K whose tweets often grab headlines, has tweeted on April 8, 2019 "why waste time in court. Wait for BJP to scrap article 370. It will automatically debar us from fighting elections since Indian constitution won't be applicable to J&K anymore. Na samjho gay tou mit jaouge aye hindustan walo. Tumhari dastaan tak bhi na hogi dastaano main".
Khajuria stated That despite having held a constitutional post of the Chief Minister of J&K and fully conscious of Section 3 of J&K constitution that J&K is and shall remain an integral part of India, she willfully and consciously made a comment which is in violation of the Constitution openly supporting the cause of separatism.
Mehbooba Mufti, has willfully tried to excite disaffection towards the Govt. of India, which is prima facie an offence of sedition under section 124-A RPC and has also committed an offence of "Promoting enmity between the classes" under sections 153,153-A, 504,505 RPC & other relevant provisions of Laws of the state including IT Act 2002.
In his complaint Khajuria stated that the seditious tweet made by Mehbooba Mufti on 08- 04-2019 is an "Incitement to violence" or "Public disorder" and falls within ambit of Section 124-A RPC which is falls under chapter Vl of the RPC and thus section 196 of CR.PC is attracted Sukesh C Khajuria in his complain had stated that according to the procedure laid down under sec.196 Crpc. District Magistrate has to file complaint and upon the complain of district Magistrate the court shall take cognizance of offence u/s 124-A RPC.
