Bari-Brahaman boy's kidnapping: Court rejects bail of 4

Jammu, June 29: A Samba court on Saturday rejected the bail applications of four persons in the much publicised kidnapping of a school boy in Bari-Brahaman.
Principal Sessions Judge, Samba, MK Sharma rejected the bail pleas of
Dheeraj Singh, son of Jodh Singh, of Motal tehsil in Udhampur; Angrez Singh, son of Kanshi Ram, of Jungel Beli tehsil in Udhampur; Baliat Singh alias Amit Singh, son of Chuni Lal, of Gool in Udhampur; and Balbir Singh, son of Magar Singh, of Bahengra tehsil in Doda.
The Judge after hearing advocate Munish Choudhary for the applicant and CPO Samba Harminder Singh for the State observed that the petitioners/accused have been arrested by the police of police station, Bari Brahmana in FIR No. 06/2019 for the commission of offences punishable under sections 364/384/347/147/120-B RPC, 3/25 A. Act and 4/6 POCSV Act with the allegations that on 06.05.2019 they kidnapped a minor school going boy while he was on way home from school for ransom. During the period of kidnapping, the petitioners/accused committed penetrative sexual assault upon the victim.
The court further observed that the accused have been charge sheeted for the commission of offences punishable u/ss364/384/347/147/120-B RPC, 3/25 A. Act and 4/6 POCSV Act. "The investigation is in progress. The statements of the witnesses have been recorded u/s 164-A & 161 Cr.P.C. In their statements, the witnesses have stated about the act done by the petitioners/accused.
At this stage, I am of the opinion that the accusation against the petitioners/ accused is prima facie true. Therefore, there is a statutory bar for grant of bail to the petitioners/accused," the court observed while rejecting the bail applications of the four accused.
