Court rejects bail for dishonouring national flag 4/20/2020 10:21:08 PM EARLY TIMES REPORT JAMMU, Apr 20: CJM Reasi Amarjeet Singh Langeh rejected the bail application of one Shakeel Ahmed, son of Abdul Hamid of Pouni, Tehsil Pouni and District Reasi, who insulted Indian National Flag. According to the police case that the accused posted a photograph/ picture on his Facebook ID showing a child, completely nude and visibly urinating on the Indian National Flag. CJM Reasi Amarjeet Singh Langeh while hearing bail application through virtual mode, observed that the result of investigation carried forward hitherto would also show that the origin of the Facebook post in question is from Pakistan. Sheer fact that the post forming subject matter of case against petitioner being overwhelmingly apparent in showing indignity and insult to the Indian National Flag (Tricolour) - ought to have evoked exacting scrutiny by petitioner as to the content thereof and desirability of its being posted on his Facebook ID. Petitioner however seems to have posted the material on his Facebook ID consciously and intentionally thereby demonstrating not only his complicity in stripping of the symbolic value of Indian National Flag but also his brazen disregard for potential consequences that can reasonably ensue once the circulation of the post is viewed by onlookers/ audience on his Facebook, a social medium open for viewership by public at large. Prima facie therefore, prosecution has made out a case of involvement of petitioner in the offences for which petitioner stands booked. Be it noted that quantum of punishment that an offence is punishable with, is only one of the circumstances and not the sole circumstance to be considered while deciding a bail application as also noted hereinabove. The offences involved in the case manifestly have a far reaching bearing on the public at large. With these observations, Court rejected the bail application.
