In-charge lecturers having distance mode degrees await postings

SRINAGAR, Jan 27: The in-charge lecturers who have acquired regular mode degrees during service without permission from competent authority have been posted but till date posting of distance mode degree holders having proper permission and due leave entered is still pending in the Kashmir valley.
A group of in-charge lecturers told Early Times that their counterparts of Jammu have been adjusted some two years back while as no such orders were issued with respect to them.
The lecturers termed the same as clear cut violation of Articles 14 and 16 of Constitution of India and denial of justice on the basis of equality.
“The administrative department constituted a committee under order 13- Edu of 2021 dated 13-1-2021 to examine the issue of distance mode degrees in light of government order 940 of Department of Education dated 17-11-17 under the chairmanship of Director Finance School Education Department with five other members,” said the lecturers.
The committee met five times and discussed the matter on case to case basis and recommended one time exemption for post facto permission and procedure for both regular and distance mode degree holders. The Director School Education Jammu acted promptly and issued posting/adjustment orders of all those masters/teachers having PG degree in distance mode from the same universities.
“Even Post Facto permission sanction was accorded by Chief Education Officers as they were empowered by Director School Education Jammu under circular DSEJ/Trg/14319-26 dated 20-6-2017. The Department of School Education has issued another format under letter number EDU/HRM/Format/2021 dated 21-10-21 to be filled by the candidate and duly countersigned by Director School Education Kashmir (DSEK),” said the lecturers.
The lecturers submitted that they have already self-attested such format and same has been countersigned by the DDOs and CEOs to DSEK. They said that DSEK has submitted the same for further action regarding posting to administrative department before two months with no follow up action taking place.
“Department of School Education regularized PG masters/ teachers having distance mode in Chemistry/ Physics/Information Technology and Botany under government order 333 and 334-Edu of 2019 dated 18-10-2019. Also the DSEJ issued posting orders in favor of almost all distance mode degree holders in subjects like Botany, Chemistry and Zoology having distance mode PG degrees,” said the lecturers.
It would be in place to mention here that with regard to the validity/ recognition of degrees obtained through distance mode of education in Jammu & Kashmir, a high level committee was constituted under government order 442-GAD of 2011 dated 13-4-2011 read with government order 558- GAD of 2011 dated 13/-5-2011. The recommendations made by the committee were approved by Jammu & Kashmir cabinet vide decision 104/14/2012 dated 16-5-2012.
The Higher Education department then issued final order 252 HE of 2012 dated 30-5-2012 regarding validity of distance mode degrees in J&K. The regulating body regarding distance education in country is the Ministry of Higher Education Government of India, UGC. Regarding validity of distance mode degrees in India it has been cleared by UGC that degrees issued through open and distance learning institutions recognized by UGC and DEC/DEB stand automatically recognized for employment and other purposes.
“All the promotees submitted relevant documents at Directorate Office Kashmir/Jammu for issuance of posting orders. The DSEK raised the query of permission and referred the permission matter to administrative department, while as DSEJ issued adjustment orders in favour of almost all distance mode degree holders from all subjects at Jammu division,” said the lecturers.
