Court directs Govt to file status report within 30 days
Teacher: student ratio in JK Schools

JAMMU, Feb 23: A Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice Pankaj Mithal and Justice Sindhu Sharma after hearing Sr. Adv Pranav Kohli with Adv Farhan Mirza for the PIL whereas AAG Amit Gupta for the UT, granted one moths' time to produce a better status report bringing on record the entire Policy and the need of the educational institutions in the Union Territory as also the existing student-teacher ratio in both the urban and rural areas.
When the PIL came-up for hearing, the Division Bench observed that the order of this court dated 15.02.2021 records that a fresh status report filed on 13.05.2019 is deficit and it does not spell out if the various infrastructure projects referred therein have been completed. Therefore, respondent no.1 was given time to file a fresh status report.
DB further observed that similarly by an order dated 07.12.2021, the respondents were directed to indicate the progress in the student-teacher ratio in both the urban and rural areas.
In pursuance thereof, a fresh report has been filed on 07.12.2021 but again this only concerns with the infrastructure projects and not with student-teacher ratio.
DB observed that a glance at the aforesaid report indicates that though various projects have been sanctioned but only limited projects have been completed and only some are in progress. DB said that the report fails to indicate as to the time limit within which the remaining projects would be completed.
DB further observed that apart, the court has not been informed about the Education Policy as well as the number of schools (Elementary High Schools and the Secondary Schools) which are required in the Union Territory and as to how many of them exist in the present with all necessary infrastructures.
In view of the above, Amit Gupta, Additional Advocate General, submits that he may be granted some more time to produce a better status report bringing on record the entire Policy and the need of the educational institutions in the Union Territory as also the existing student-teacher ratio in both the urban and rural areas.
DB grants one months' time to the status report within a month supported by an affidavit of a Senior Officer not below the rank of Secretary to Government, Department of Education.
